The Site is owned and operated by Empower Home Services (“Empower,” “we,” “us,” or “our”).

6. Warranty and Maintenance Disclaimer
Empower may provide workmanship warranties and may install products that include manufacturer warranties. Manufacturer warranties often require routine maintenance and documentation (for example, recurring HVAC tune-ups) to keep coverage valid. Empower does not guarantee any manufacturer warranty outcome and is not responsible for warranty denials based on maintenance history, misuse, unauthorized repairs, or other exclusions.

7. User Communications and Consent
By providing your phone number, email, or other contact information through the Site, you consent to receive communications from Empower related to your request, including calls, emails, and texts.Message and data rates may apply.You can opt out of marketing texts at any time by replying STOP (where applicable).Opting out may not stop transactional or service-related communications.

12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMPOWER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE.
IN NO EVENT WILL EMPOWER’S TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE EXCEED $100 OR THE AMOUNT YOU PAID TO EMPOWER THROUGH THE SITE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.
Some states do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification
You agree to defend, indemnify, and hold harmless Empower and its officers, directors, employees, contractors, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your violation of these Terms, or your violation of any rights of another.

14. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict of law rules.
Any legal action arising out of or related to these Terms or the Site must be brought in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.

15. Termination
We may suspend or terminate access to the Site at any time if we believe you have violated these Terms or used the Site unlawfully.
